THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!
The Volunteer desires to work as a Volunteer for The Dragonfly Foundation (referred as Dragonfly) and engage in the Activities related to being a volunteer (the “Activities”). The Volunteer understands that the Activities may include bending, walking stooping, moving/lifting items less than 30 lbs., working in Dragonfly facilities and at external events as directed by Dragonfly.
The Volunteer hereby freely, voluntarily and without duress executes this Release under the following terms: Release, Waiver, and Covenant Not To Sue.
Do hereby, on our own behalf, and on behalf of our personal representatives, heirs, next of kin, and on behalf of the organization so undersigned, release, waive and covenant not to sue The Dragonfly Foundation, its officers, directors, employees, volunteers and agents (hereinafter Releasees) from any and all liability to the undersigned from any and all loss, injury or damage, whether caused by the negligence of Releases or otherwise. Volunteer understands that this Release discharges Dragonfly from any liability or claim that the Volunteer may have against Dragonfly with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Volunteer’s Activities with Dragonfly, whether caused by the negligence of Dragonfly or its officers, directors, employees, agents or otherwise. Volunteer also understands that Dragonfly does not assume any responsibility for or obligation to provide financial assistance or other assistance, including, but not limited to, vehicle, medical, health or disability insurance in the event of injury or illness.
Medical Treatment. Volunteer does hereby release and forever discharge Dragonfly from any claim whatsoever which arises or may hereafter arise on account of any first-aid, treatment, or service rendered in connection with the Volunteer’s Activities with Dragonfly.
Assumption of the Risk. The Volunteer understands that the Activities include work that may be hazardous to the Volunteer, including, but not limited to, light labor, loading and unloading, and transportation to and from the event sites. Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Dragonfly from all liability for injury, illness, death or property damage resulting from the Activities.
Insurance. The Volunteer understands that, except as otherwise agreed to by Dragonfly in writing; Dragonfly does not carry or maintain health, medical or disability insurance coverage for any Volunteer.
Photographic Release. Volunteer does hereby grant and convey unto Dragonfly all right, title and interest in any and all photographic images and video or audio recordings made by Dragonfly during the Volunteer’s Activities with Dragonfly, including, but not limited to, any royalties, proceeds or other benefits derived from such photographs or recordings.
Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the States of Ohio, and that this Release shall be governed by and interpreted in accordance with the laws of the States of Ohio. Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of the Release which shall continue to be enforceable.
The Volunteer agrees to indemnify and save and hold harmless the Releasees from any loss, liability or damages to third persons or property arising out of our participation in events related to The Dragonfly Foundation or its constituents, supporters or event venues.
THE VOLUNTEER HAS READ AND VOLUNTARILY ELECTRONICALLY SIGNS THIS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, AND FURTHER AGREES THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENTS APART FROM THIS WRITTEN AGREEMENT HAVE BEEN MADE OR CAN MODIFY THIS WRITTEN AGREEMENT
